  1. 1. OVERVIEW

a. Welcome to African Live Art (the Company), the operators of Africanliveart.com website (the “Site”). The Company is dedicated to, among other things, market Afro-Centric and African Arts (in its various forms) and history to various institutions such as Universities, Libraries, Arts Organizations and individuals across the world. This vision is driven by the fact that there is increasing misrepresentation, distortion and manipulations of African Art and History among others in the global space and thus, it is our mission to give the platform for Africans to tell their own stories

 b. Protecting your PRIVACY IS OUR PRIORITY. This policy governs our data collection and usage. This notice describes our privacy policy (“Privacy Policy”) for the general-audience. The Site offer registered users the opportunity to engage various Instructors for Afro-Centric and African Arts (in its various forms) and African History via a virtual platform. 

c. By using the Sites and App, you consent to the current version of our Privacy Policies.  If you have questions or concerns regarding our Privacy Policies, you should contact the Company for further clarification.

2. CHILDREN UNDER 18

a. African Live Art does not knowingly collect, either online or offline, personal information from persons under the age of eighteen. If you are under 18, you may use Africanliveart.com only with permission and or guidance of a parent or guardian. If we become aware that a child under 18 has provided us with personal information, we will take steps to remove that information and terminate the applicable account.

b. Our general-audience Site and App are not directed to people under 18 years of age.  If you become aware that your child or guardian has provided us with personal information through the Site or App without your consent, please contact us immediately.  

3. INFORMATION WE COLLECT AND IT’S USE.

a. Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience.  This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience better and easier.

b. You may browse certain portions of our Site without providing us with personally identifiable information.  Engaging an Instructor however through a video session, require you to register through the Site or App, in which case we would collect and store information, including personal information, that is voluntarily supplied to us by you when registering on the Site or App.

c. You can choose not to provide us with certain information, but by doing so, you may not be able to take advantage of our Site and App features and functionality. Once you give us your personal information, you are no longer anonymous to us.

d. In addition to the specific usages outlined below, we may generally use any information we collect for the following purposes:

i. For the purpose for which you provided the information to us, such as to create and maintain a user account for you;

ii. To provide the features and functionality of the Site and App to you;

iii. To personalize the content you see based on your personal characteristics and preferences;

iv. Improving our Site, App and other products and services;

v. To troubleshoot problems, provide you with required notices, enforce our User Agreement or to alert you to changes in our policies or agreements that may affect your use of the Site or App.

4. INFORMATION WE COLLECT ABOUT SITE USERS

a. Log Files

African Live Art, like many websites, gather certain information about our Site traffic and store it in log files. In doing this, the Company follows a standard procedure of using log files. These files log visitors when they visit websites, as part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.

b. Cookies & Web Beacons

We may use cookies and other tracking technologies on the Site or App to help customize the Site or App and improve your experience. When you access the Site or App your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site or App. Web Beacons can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

5. INFORMATION WE COLLECT FROM REGISTERED USERS OF THE SITE AND APP

a. Registration

During registration you are required to give truthful contact information in accordance with our User Agreement.  Registration requires you to provide us with: 

(i) First and last name

(ii) age

(iii) a unique user name and password,

(iv) your e-mail address, 

(v) your country of domicile, 

(vi) telephone number, and 

(vii) your preferred gender.  

We use this information to create an account for you on the Site or App, contact you about the services on our Site and App in which you have expressed interest, and customize your experience based on your preferences

b. Usage Information

In order to provide you with the best experience, we will collect data on your use of the Site and App, including but not limited to:

(i) how long your video/virtual sessions last, 

(ii) what features of the Site and App you are using, 

(iii) when you access the Site and App and relevant features.  

We may use all of the foregoing information as set forth in this Privacy Policy.

6. DEVICE INFORMATION

When you use the App, we will collect non-personally identifiable information about the device you use to access the App, including but not limited to: 

(i) the device type, operating system and mobile carrier, 

(ii) language used by the device, and 

(iii) time zone used by the device.  

7. PAYMENT

a. In order to engage an Instructor for lessons the Site or App, you must purchase minutes prior to beginning a session or pay in accordance with the terms and conditions of another payment plan, such as a monthly subscription. (When in doubt, refer to our User Agreement).

b. If you purchase our products and services, we will collect billing and credit card information. This would be used to complete the purchase transaction.

8. RECORDING OF SESSIONS

a. We use a live video platform operated by Zoom Video Communications, Inc. (Zoom) to provide you with ability to engage various Instructors through live video.  Zoom Video Communications, Inc. (Zoom) stores a recording of the video chat on their servers, and provides us access to that data.  We also reserve the right to record sessions for quality assurance, instructor review and dispute resolution purposes. 

b. If you engage in a video session on the Site or App, the session may be recorded as described above and in the User Agreement.  We may use such recordings for our internal business purposes, including without limitation for purposes of Instructor evaluation, Instructor training, dispute resolution and improving our service.  The recording may be made available to you and/or the other party to the recording for future viewing through the Site and/or App, or to you individually for review.  

9. INSTRUCTOR NOTES

In order to provide you with a seamless exchange between multiple Instructors, the Instructor may take notes on your conversation, based on information you provide during the video sessions.  This information includes, but is not limited to, your: age, preferred gender, Instructor preferences (e.g. gender of the Instructor), and interests.  We may retain any such information and associate it with your personally identifiable information.  This information will only be available the Company’s personnel and the Instructors with whom you interact.  We may use this information to match you with a particular Instructor available on the Site and App and to provide you with information and services that are more likely to be of interest to you.

10. CORRESPONDENCE

a. If you choose to leave us feedback, we will collect the information you send us.  We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law.

b. If you send us personal correspondence, such as e-mails or letters, or if other users or third parties send us correspondence about your activities or postings on the Site and App, we may collect such information into a file specific to you.

11. SPECIAL OFFERS AND UPDATES

We will not provide your personally identifiable information to third parties for their own marketing purposes without your consent. Any special offers we may give and updates may vary due to seasons.  

12. SERVICE-RELATED ANNOUNCEMENTS

We will send you strictly service-related announcements on rare occasions when it is necessary to do so.  For instance, if our service is temporarily suspended for maintenance, we might send you an e-mail.

Generally, you may not opt-out of these communications, which are not promotional in nature.  If you do not wish to receive them, you have the option to deactivate your account.

13. CUSTOMER SERVICE

We will communicate with you in response to your inquiries, to provide the services you request, and to manage your account.  We will communicate with you by e-mail, using the e-mail address provided by you to us when you registered on the Site or App.

14. AGGREGATE INFORMATION (NON-PERSONALLY IDENTIFIABLE)

We may share aggregated demographic information about our user base with our actual and potential advertisers and business partners.  This information does not identify individual users.

15. OTHER USERS

If you engage in any communication with another Site or App user, such user shall receive syour user name, as well as any other personal information you may choose to share in connection with that communication.

16. INSTRUCTORS

If you engage in a video session or any other communication with an Instructor, such Instructor shall receive your user name, as well as any other personal information you may choose to share in connection with such session.  Instructors may include any information you provide in their notes (see above).

17. SHARE TO SOCIAL NETWORKING SITES

a. The company will not share any of your video recording sessions from the Site to social media. The video recorded sessions will be used for internal training purposes only. Therefore the company reserves the right to use video recording sessions internally with or without your consent.

b. At the end of a session, you may only share your sessions provided you obtain the express consent of your instructor.  By “sharing” a session, you acknowledge that your posting is subject to the terms and conditions of the applicable social networking site.  The Company are not liable for any impermissible use of content on any social networking site or any other consequences of posting content on a social networking site.

18. BUSINESS PARTNERS

We may disclose non-personally identifiable information to third party partners in furtherance of our business arrangements with them, including without limitation to jointly offer a product or service to you or create interoperability between our products and services and the products and services of such partners.

19. SERVICE PROVIDERS

We may use contractors and third party service providers in connection with the Site and App. When our contractors or service provider obtain access to your personally identifiable information, they are required to protect it in a manner that is consistent with this Privacy Policy by, for example, not using it for any purpose other than to carry out the services they are performing for the Company.

20. OTHER DISCLOSURES

We reserve the right to disclose your personally identifiable information or any other information as required by law or when we believe that disclosure is necessary to protect our rights or the rights of a third party; to comply with a judicial proceeding, court order, or legal process; or in connection with an actual or proposed merger, acquisition or other corporate transaction or insolvency proceeding involving all or part of the business or asset to which the information pertains.

21. LINKS TO OTHER WEBSITES

The Site and App may contain links to third-party websites and applications of interest, including advertisements and external services that are not affiliated with African Live Art. Once you have used these links to leave the Site and App, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Site and App.

22. ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION

If your personally identifiable information changes, or if you no longer desire our service, you may correct, update, delete or deactivate it by making the change on our member information page, e-mailing our Customer Support or by contacting us by telephone or postal mail at the contact information listed below.

23. SECURITY

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it but no method of transmission over the Internet, or method of electronic storage, is 100% secure.  Therefore, while we will use all legal means possible to protect your personal information, we cannot guarantee its absolute security.

24. NON-GHANAIAN USERS

By using the Site or App, you consent to the transfer of information outside of your country.

25. CHANGES TO OUR PRIVACY POLICY

If our Privacy Policy changes, you will be duly notified of such change. We reserve the right to modify this Privacy Policy at any time, and such change will apply with respect to information you provide or your activity on the Site and App after the change in policy, so please review it frequently. If we make changes that materially affect our uses or disclosures of personally identifiable information that we have previously collected, we will contact you by e-mail, or by means of a notice on the Site and App.
